Cal Tan recently brought a suit in federal court against online retailer. The suit alleged a violation of state and federal copyright infringement laws and state and federal unfair competition statutes. The owners of www.thesupplenet.com refused to cease the unlawful display and sale of Cal Tan products. In a summary judgment motion brought by Cal Tan, the court ultimately ruled in favor of Cal Tan on 33 counts of copyright infringement that could have carried statutory damages of up to $5 million. Rather than proceeding to trial, Cal Tan and www.thesupplenet.com settled the matter. As a result, www.thesupplenet.com is prohibited from distributing or selling Cal Tan products and paid a significant sum of money to Cal Tan.
